BODACC publication: how does it work?

The BODACC (official bulletin of civil and commercial announcements) publishes acts from the trade register. You do not publish yourself: the source is always a court registry.

Who triggers publication?

For insolvency proceedings, the court registry forwards the judgment to DILA, which publishes it in the BODACC. The director has no publication step to do personally.

For a sale of a business (fonds de commerce), legal notice is given through a legal-announcement outlet, then a BODACC insertion is made by the registry upon registration; it opens the creditors’ opposition period.

Step by step

An act is filed or ruled on (insolvency, registration, business sale…).
The registry transmits the data to DILA.
DILA publishes the notice in the BODACC, online and as open data (data.gouv.fr).
Consultation is free; certain steps (opposition, complaint) run from that publication.

No. BODACC insertions come from the registries via DILA. An individual or company does not file a notice directly in the BODACC.
